VintageBay.au – Terms & Conditions

By creating an account, paying the membership fee, listing items, bidding in auctions, or buying items on VintageBay.au (the “Platform”), you agree to these Terms & Conditions (“Terms”). If you do not agree, you must not use the Platform.


1. Overview of the Service

VintageBay is an online marketplace dedicated to vintage, retro, collectible and second-hand items. The Platform allows users to list and purchase items using both “Buy Now” and auction formats.

VintageBay only provides the platform that connects buyers and sellers. We do not buy or sell items ourselves, do not inspect items, and do not act as an agent or representative for any user.

VintageBay is not responsible for:

  • Payment processing or money flow between users
  • Any disputes between buyers and sellers
  • Shipping, delivery, packaging, or handling of items

All transactions are strictly between the buyer and seller.

2. Membership Fee

To access and use the Platform, including listing items and participating in auctions or “Buy Now” purchases, all users must maintain an active membership.

  • The membership fee is $4.99 AUD per year.
  • The fee is charged once per year per account.
  • Membership fees are non-refundable, including where you choose not to use the service, close your account early, or do not complete any transactions.

Continued use of the Platform after your membership renewal date requires payment of the then-current membership fee.

VintageBay may change membership pricing at any time. We will provide at least 30 days’ notice by email or on the Platform before price changes take effect.

3. User Accounts

To use VintageBay, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Keep your login credentials secure and confidential
  • Not share your account with others

You are responsible for all activity that occurs through your account.

We may suspend or terminate your account at our discretion, including for:

  • Suspected fraud or illegal activity
  • Abusive or harmful behaviour
  • Violation of these Terms
  • Non-payment of membership fees
  • Excessive or repeated disputes and complaints from other users

4. Listings, Buy Now & Auctions

Users who list items (“Sellers”) are fully responsible for their listings and must ensure that:

  • Descriptions are truthful, accurate, and not misleading
  • The condition of the item is clearly disclosed
  • Photos accurately represent the item
  • Shipping costs and methods are accurate
  • Listings comply with applicable Australian laws (including consumer law and product safety requirements)
  • Items do not infringe any intellectual property rights (e.g. counterfeit, bootleg or unauthorised reproductions)

VintageBay does not verify the authenticity, quality, safety, legality, or value of any items listed on the Platform.

4.1 Buy Now

When a buyer confirms a “Buy Now” purchase, a binding contract is formed between the buyer and the seller. Both parties are expected to complete the transaction as agreed.

4.2 Auctions

On auction listings:

  • Placing a bid is an offer to purchase the item at the bid price.
  • When the auction ends and you are the highest bidder (and the reserve, if any, is met), a binding contract is formed between you and the seller.
  • Bidders and sellers are responsible for honouring the auction outcome.

VintageBay does not manage or enforce auction contracts and is not a party to any sale contract between users.

5. Transactions & Payments

VintageBay does not handle payments and does not operate as an escrow or payment intermediary.

All payment arrangements are made directly between buyers and sellers. This includes:

  • Choosing the payment method (e.g. bank transfer, PayPal, cash on collection, etc.)
  • Agreeing on payment timing
  • Managing refunds, chargebacks, or partial payments

You acknowledge and agree that:

  • Any use of third-party payment services is at your own risk.
  • VintageBay is not responsible for any loss, fraud, chargeback, or failure of payment.
  • VintageBay does not provide buyer or seller protection in relation to payments.

6. Shipping, Delivery & Risk

Shipping is arranged directly between buyer and seller. The seller is responsible for:

  • Packaging the item safely and appropriately
  • Using the agreed shipping method
  • Charging fair and accurate shipping costs
  • Dispatching the item within a reasonable or agreed time

The buyer is responsible for:

  • Providing a correct and complete delivery address
  • Paying shipping costs as agreed
  • Communicating with the seller regarding delivery issues

VintageBay has no control over and accepts no liability for:

  • Lost, stolen, delayed, or damaged parcels
  • Items not matching the listing description
  • Items being faulty, unsafe, or not fit for purpose

7. Disputes Between Users

Any dispute concerning payment, item condition, misrepresentation, shipping, delivery, or refunds is strictly between the buyer and the seller.

VintageBay does not:

  • Provide dispute resolution services
  • Issue refunds on behalf of users
  • Enforce contracts between users

Users are encouraged to communicate and attempt to resolve disputes directly. Where appropriate, users may seek advice from consumer protection bodies or pursue legal options under applicable Australian law.

VintageBay may, at its discretion, warn, suspend, or terminate accounts where serious or repeated complaints arise, but is under no obligation to do so.

8. Prohibited Items

The following items must not be listed on VintageBay:

  • Illegal goods of any kind
  • Weapons or items prohibited by Australian law
  • Counterfeit, replica, or pirated goods
  • Stolen goods or items with unclear ownership
  • Hazardous materials or items that breach postal or transport regulations
  • Items that violate intellectual property rights
  • Items that are otherwise inappropriate or prohibited by VintageBay policies

VintageBay reserves the right to remove any listing at any time without notice.

9. Platform Availability & Changes

VintageBay is provided on an “as-is” and “as-available” basis. We do not guarantee that the Platform will always be available, secure, or error-free.

We may modify, suspend, or discontinue any part of the Platform at any time, including features, membership models, or access rules.

We are not responsible for any loss you may suffer as a result of:

  • Downtime or technical issues
  • Loss of data or content
  • Changes to or removal of features

10. Limitation of Liability

To the maximum extent permitted by law, VintageBay and its owners, directors, employees, and affiliates will not be liable for any direct, indirect, incidental, consequential, or special loss or damage arising out of or in connection with your use of the Platform, including but not limited to:

  • Loss of money or payments
  • Loss, theft, or damage of items
  • Misrepresentation or conduct by other users
  • Loss of profits, business, or opportunities
  • Data loss or service interruptions

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Australian law, including under the Australian Consumer Law.

11. Indemnity

You agree to indemnify and hold VintageBay harmless from any claims, demands, losses, damages, costs, or expenses (including legal fees) arising out of or in connection with:

  • Your use of the Platform
  • Your breach of these Terms
  • Your listings, sales, purchases, or other transactions
  • Your infringement of any third-party rights

12. Intellectual Property

All content on the Platform, including our logo, branding, site design, text, graphics, and layout, is owned by or licensed to VintageBay and is protected by intellectual property laws.

You must not copy, reproduce, modify, distribute, or create derivative works from any part of the Platform without our prior written consent, except as permitted by law.

13. Termination

We may suspend or terminate your access to the Platform at any time if we believe you have breached these Terms, engaged in fraudulent or illegal activity, or for any other reason at our discretion.

Upon termination:

  • Your right to use the Platform ceases immediately.
  • We may retain certain information as required by law or for legitimate business purposes.
  • You are not entitled to any refund of membership fees already paid.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on the Platform with an updated “Last updated” date.

Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Western Australia, Australia. You agree to submit to the non-exclusive jurisdiction of the courts and tribunals of Western Australia in relation to any dispute arising out of or in connection with the Platform or these Terms.
